Terms of Service
Please read these terms carefully before booking your boudoir session. By scheduling a session with Touchless Photography, you agree to the following terms and conditions.

Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Touchless Photography ("we," "us," "our," or "Photographer") regarding your use of our boudoir photography services. By booking a session, paying a deposit, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree with any part of these Terms, please do not book a session with us.
Services Provided
Touchless Photography provides professional boudoir, intimate portrait, and empowerment photography services. Our sessions may include but are not limited to:
- Women's Empowerment Boudoir Sessions
- Couples Boudoir Sessions
- Maternity Boudoir Sessions
- Bridal Boudoir Sessions
- Mini Sessions and Special Promotions
- Pre-session consultations and wardrobe guidance
- Professional hair and makeup services (where included)
- Post-production editing and image delivery
- Print products, albums, and wall art
Booking & Scheduling
Booking Process: To secure your session date, a non-refundable retainer (deposit) is required. Your session is not confirmed until we receive your retainer payment and signed contract.
Retainer Amount: The retainer amount varies by session type and will be clearly communicated during booking. Retainers are typically 50% of the session fee or a minimum flat rate, depending on the package selected.
Session Confirmation: You will receive a confirmation email with your session date, time, location, and preparation guidelines within 48 hours of booking.
Age Verification: All clients must be 18 years of age or older. Valid government-issued photo identification is required at the time of your session.
Payment Terms
Session Fees: Session fees cover the photography session itself, including studio time, professional lighting, and the photographer's time and expertise. Image collections and products are purchased separately during your reveal/ordering appointment.
Payment Methods: We accept major credit cards, debit cards, e-transfer, and cash. Payment plans may be available for larger purchases—please inquire.
Remaining Balance: Any remaining session fee balance is due on the day of your session, prior to the session beginning.
Product Payments: Payment for image collections, prints, albums, and other products is due in full at the time of ordering. Products are not released until payment is received in full.
Pricing: All prices are in Canadian Dollars (CAD) and are subject to applicable taxes. Prices are subject to change without notice, but quoted prices will be honored for booked sessions.
No Refund Policy
ALL SALES ARE FINAL. NO REFUNDS WILL BE ISSUED UNDER ANY CIRCUMSTANCES.
This includes, but is not limited to:
- Session retainers/deposits
- Session fees
- Image collections and digital files
- Print products, albums, and wall art
- Gift certificates and vouchers
- Add-on services
Retainer Policy: Your retainer reserves your session date exclusively for you and compensates the photographer for turning away other potential bookings. Retainers are non-refundable and non-transferable.
Session Credits: In the event that you cannot attend your scheduled session and provide adequate notice (see Cancellation & Rescheduling below), your retainer may be applied as credit toward a future session at our discretion, but it will not be refunded.
Product Satisfaction: We stand behind the quality of our work. If a product arrives damaged or defective due to manufacturing or shipping, we will replace it at no additional cost. This does not constitute a refund.
Cancellation & Rescheduling
Rescheduling with 14+ Days Notice: Sessions may be rescheduled one time at no additional charge if we receive notice at least 14 days before your scheduled session date. The rescheduled session must occur within 90 days of the original date.
Rescheduling with 7-13 Days Notice: Sessions rescheduled with 7-13 days notice may be subject to a $75 rescheduling fee to cover administrative costs and lost booking opportunities.
Rescheduling with Less Than 7 Days Notice: Sessions rescheduled with less than 7 days notice are subject to a $150 rescheduling fee. If hair and makeup services were booked, you will also be responsible for the full cost of those services as our artists cannot be rebooked on short notice.
No-Shows: Failure to arrive for your scheduled session without prior notice will result in forfeiture of your entire retainer and session fee. No credits or rescheduling will be offered.
Illness or Emergency: We understand that life happens. If you are ill or experience an emergency, please contact us as soon as possible. We will work with you to reschedule within reason, though documentation may be required.
Photographer Cancellation: In the rare event that we must cancel your session due to illness, emergency, or unforeseen circumstances, you will have the option to reschedule at no cost or receive a full refund of all payments made.
Session Guidelines & Expectations
Comfort & Boundaries: Your comfort and safety are our top priority. You are always in control of your session. You may stop or pause at any time, decline any pose, or request adjustments. Communication is key—please let us know if you have any concerns.
What to Bring: We will provide a detailed preparation guide before your session. Generally, you should bring wardrobe options, personal items you'd like included, and your ID.
Sobriety: For your safety and the quality of your images, clients must be sober during their session. Clients who appear to be under the influence of alcohol or drugs will be asked to reschedule, and standard rescheduling fees will apply.
Guests: Due to the intimate nature of boudoir photography, guests are generally not permitted during your session unless previously arranged (e.g., couples sessions or approved support persons). Please discuss any guest requests before your session date.
Children & Pets: Children and pets are not permitted at boudoir sessions for safety, privacy, and to ensure you can fully relax and enjoy your experience.
Image Delivery & Timelines
Reveal/Ordering Appointment: Approximately 1-3 weeks after your session, you will be invited to a reveal appointment where you will view your professionally edited images and select your favorites for your collection.
Digital Image Delivery: Purchased digital images will be delivered via password-protected online gallery within 1-2 weeks of your ordering appointment.
Print Products: Physical products such as prints, albums, and wall art require 4-8 weeks for production and delivery. Rush orders may be available for an additional fee.
Image Selection: Only images you purchase will be delivered. Unpurchased images are not available for future purchase and will be deleted according to our retention policy.
Copyright & Usage Rights
Photographer's Copyright: All images created during your session are the intellectual property of Touchless Photography and are protected by Canadian copyright law. The photographer retains full copyright of all images.
Client Usage License: Upon purchase, you receive a personal use license for your images. This license permits you to:
- Print copies for personal use
- Share on personal social media accounts
- Use for personal gifts and keepsakes
- Display in your home
Prohibited Uses: Without written permission, you may NOT:
- Use images for commercial purposes or advertising
- Sell or license images to third parties
- Enter images in contests or submit to publications
- Alter, edit, or apply filters to images
- Remove watermarks or photographer credits
- Use images for content creation platforms (OnlyFans, etc.) without commercial licensing
Commercial Licensing: If you wish to use your images for commercial purposes, please contact us to discuss commercial licensing options and fees.
Model Release & Portfolio Use
Optional Participation: You may be asked to sign a separate Model Release form granting permission to use select images for portfolio, marketing, or educational purposes. Signing a model release is completely optional and has no bearing on your session experience, pricing, or the service you receive.
Anonymity Options: If you consent to portfolio use, you may choose to remain anonymous. We will never publish your name, identifying information, or face (if requested) alongside any shared images.
Image Selection: You will have the opportunity to approve which specific images may be used for portfolio purposes.
Revocation: You may revoke your model release at any time by providing written notice. We will remove your images from our active marketing materials within 30 days, though we cannot guarantee removal from materials already printed or distributed.
Limitation of Liability
Technical Failures: While we take every precaution to ensure your images are captured and delivered safely, in the unlikely event of equipment failure, memory card corruption, or other technical issues beyond our control, our liability is limited to a refund of session fees paid or a complimentary reshoot at our earliest availability.
Maximum Liability: In no event shall Touchless Photography's total liability exceed the amount paid by the client for the specific services in question.
Exclusions: We are not liable for any indirect, incidental, consequential, or punitive damages arising from your session or use of our services.
Force Majeure: We are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemic restrictions, civil unrest, or acts of government.
Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law principles.
Any disputes arising from these Terms or your use of our services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in Edmonton, Alberta, in accordance with the Arbitration Act of Alberta.
Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date. Your continued use of our services after any changes constitutes acceptance of the modified Terms. The Terms in effect at the time of your booking will govern your session.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
